Are Georgia courts more likely to award custody to mothers than to fathers?

No. The Georgia courts do not recognize a presumption in favor of either the mother or father. Rather, custody is determined on the best interest of the child at the time of the divorce or dissolution. There’s a lot of factors that go into the best interest of the child, which is why it’s important to consult with a divorce attorney during a child custody matter.
