Can my spouse tell me that I cannot see my kids?

Return to FAQ Videos

During the divorce process, one spouse cannot tell the other that they don’t have the right to see the children. This doesn’t mean that it doesn’t happen from time to time though. In such cases, it may be appropriate to seek a temporary hearing with the court in order to fix both parent’s rights to the children during the divorce process, pending a final agreement or order of the court.
